These Terms and Conditions govern all services provided by Tony's Cafe Racers (Luke Cuthbert t/a Tony's Cafe Racers) to clients. By requesting a quote, making a payment, or engaging our services, you agree to these terms in full.
1. About Us
Tony's Cafe Racers is a sole proprietorship operated by Luke Cuthbert, trading as Tony's Cafe Racers, based in Cape Town, South Africa. We specialise in labour-only cafe racer motorcycle conversions and associated mechanical, fabrication and finishing work.

2. Scope of Service
Tony's Cafe Racers operates on a labour-only model. This means:
- All quoted amounts cover labour only — the skill, time and expertise of our team
- All parts, components, materials and consumables required for the build are supplied by the client unless explicitly stated otherwise in writing
- We do not mark up or resell parts. Clients source their own parts at their own cost
- Where specialist sub-contracted work is required (e.g. chrome plating, upholstery, precision machining), we will coordinate and manage the sub-contractor on the client's behalf. Sub-contractor costs are invoiced separately and are not included in the labour quote
- All quality control, transport coordination, job specifications and client communication are handled in-house by Tony's Cafe Racers
What is included in every build: Strip and assessment, specified labour tasks as per the accepted quote, reassembly, final setup and quality check, and all job management and logistics coordination.
The specific scope of work for each build is set out in the written quote issued to the client. No work outside the agreed scope will be undertaken without a revised written quote and client approval.
3. Quotes & Acceptance
- All quotes are provided in writing via email and are valid for 30 days from the date of issue
- Quotes are based on the information provided by the client and a visual inspection of the donor motorcycle. Additional work identified during the build that falls outside the original scope will be quoted separately
- A quote is accepted and a build slot confirmed only upon receipt of the required deposit payment
- Verbal agreements do not constitute acceptance. Written confirmation and payment are required
4. Payment Terms
The following payment structure applies to all builds:
- Deposit: A deposit of 50% of the total quoted labour amount (or such other amount as agreed in writing) is required to confirm your build slot. Work will not commence until the deposit has cleared
- Balance: The remaining balance is due in full upon completion of the build, before the motorcycle is released for collection or delivery
- Full payment upfront: Clients may elect to pay the full quoted amount in advance. This may be offered a priority position in the build queue at our discretion
- Additional work: Any additional work approved during the build is invoiced separately and is due upon completion
Payments are processed securely via PayFast, South Africa's leading payment gateway. Tony's Cafe Racers never stores your card details. Accepted payment methods include credit card, debit card and EFT.
All amounts are quoted and invoiced in South African Rand (ZAR). Prices are exclusive of VAT. Tony's Cafe Racers is not currently registered as a VAT vendor.
5. Estimated Timelines
An estimated build duration is provided in the written quote. This estimate is given in good faith and is subject to the following:
- Timelines are estimates only and not guarantees. Build complexity, parts availability and unforeseen mechanical issues may affect duration
- The build clock starts from the date the deposit clears and the donor motorcycle is delivered to our workshop
- If parts sourced by the client are delayed, the timeline will be extended accordingly. Tony's Cafe Racers accepts no liability for delays caused by parts availability
- We will keep the client informed of progress and notify them promptly of any material delay
- Sub-contracted work (chrome, upholstery etc.) may extend overall timelines and is subject to the sub-contractor's own lead times
6. Client Responsibilities
- The client is responsible for sourcing and delivering all parts, components and materials required for the build as specified in the quote
- The client must ensure that the donor motorcycle is legally owned by them and that all relevant paperwork (registration, roadworthiness) is in order
- The client must arrange delivery and collection of the motorcycle to and from our workshop at their own cost and risk
- Motorcycles left at our workshop beyond 14 days after completion notice has been issued may incur a storage fee of R150 per day
- Tony's Cafe Racers accepts no responsibility for pre-existing mechanical defects on the donor motorcycle that were not disclosed or visible at the time of quoting
7. Refunds & Cancellation Policy
We understand that circumstances change. Our cancellation and refund policy is as follows:
- Cancellation before work commences: If the client cancels after paying a deposit but before any work has begun, a cancellation fee of 20% of the deposit will be retained to cover administrative costs. The balance of the deposit will be refunded within 14 business days
- Cancellation after work has commenced: If the client cancels after work has begun, the client will be invoiced for all labour completed to date at the agreed hourly rate, plus any sub-contractor costs already incurred. Any deposit balance remaining after these deductions will be refunded
- No refund on completed work: Once a build is complete and the client has taken delivery, no refund will be issued for labour already performed
- Disputes: If the client is dissatisfied with any aspect of the work, they must notify Tony's Cafe Racers in writing within 7 days of collection. We will assess the complaint and, where the issue falls within our scope of work, rectify it at no additional cost
- Parts: Parts sourced by the client are non-refundable by Tony's Cafe Racers as we are not the supplier
Tony's Cafe Racers retains full responsibility for the quality of all labour performed and will handle all service disputes directly with the client. Payment disputes processed through PayFast will be managed in accordance with PayFast's dispute resolution process.
8. Liability
- Tony's Cafe Racers carries out all work with reasonable skill and care in accordance with industry standards
- Our liability is limited to the value of the labour quoted and paid for. We accept no liability for consequential loss, loss of use, or any indirect damages
- We do not insure client motorcycles while in our care. Clients are encouraged to maintain their own insurance cover during the build period
- Any modifications made to a motorcycle may affect its roadworthiness certification. It is the client's responsibility to obtain any required roadworthy certificate after completion of the build
9. Privacy
We collect only the personal information necessary to provide our services — name, contact details and motorcycle information. This information is used solely for the purpose of managing your build and communicating with you. We do not share your personal information with third parties except where required to complete the service (e.g. sub-contractors) or as required by law.
Payment processing is handled by PayFast. We do not store payment card details. Please refer to PayFast's own privacy policy at payfast.co.za for details of how payment data is handled.
10. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes that cannot be resolved directly between the parties will be subject to the jurisdiction of the South African courts.
These terms may be updated from time to time. The current version will always be available at tonyscafe.co.za/terms.html. Continued use of our services constitutes acceptance of the current terms.
